PROTOCOL- CHIEF JUDGE OF LAGOS, ADMIN JUDGES AND OTHER JUDGES, COMMISSIONER OF POLICE AND OTHER STAKEHOLDERS IN THE CRIMINAL JUSTICE SECTOR.

IT GIVES ME GREAT PLEASURE TO BE INVITED TO THIS WORKSHOP TO CONSIDER AND DELIBERATE ON THE DRAFT SENTENCING GUIDELINES FOR OUR CRIMINAL COURTS. THE REFORM OF CRIMINAL JUSTICE SECTOR IS A CARDINAL PROGRAMMME OF THE ADMINISTRATION OF HIS EXCELLENCY- GOVERNOR AKINWUNMI AMBODE, AND HE ASKED ME TO REITERATE HIS COMMITMENT TO THE JUDICIARY TO KEEP HIS ELECTION PROMISE OF MAKING LAGOS A SAFE PLACE TO LIVE AND WORK.

AS YOU DELIBERATE ON THE SENTENCING GUIDELINES, WE NEED TO REMEMBER THAT SENTENCING IS THE FRUIT OF ADMINISTRATION OF CRIMINAL JUSTICE, WHICH MUST REFLECT THE CARDINAL PRINCIPLES OF ENSURING JUSTICE FOR VICTIMS OF CRIMES, THE DEFENDANTS AND THE LARGER SOCIETY. OUR JUDGES MUST ALWAYS BEAR THIS IN MIND IN SENTENCING THE CONVICTS IN OUR COURTS. THE SOCIETY EXPECTS THAT OUR SENTENCES MUST BE ROBUST TO ENSURE THAT THE THREE CARDINAL UNDERLINING PRINCIPLES OF SENTENCING- PROTECTION OF THE SOCIETY THROUGH PREVENTION OF CRIMES, DETERRENCE, REHABILITATION AND PUNITIVE ARE UPHOLD.

THE CONVICTED SHOULD RECEIVE SMART SENTENCES THAT WILL PREVENT THEM FROM RE-OFFENDING AND AT THE SAME TIME REPOSE CONFIDENCE IN THE PUBLIC THAT JUSTICE IS ACHIEVED. WE MUST ENSURE THAT WE DETER POTENTIAL OFFENDERS FROM INCLINATION OR MOTIVATION TO COMMIT CRIMES. WE MUST ENSURE THAT CRIMES DOES NOT PAY, BY USING THE SENTENCING GUIDELINES TO DENY CRIMINALS THE PROCEEDS OF CRIMES.

SENTENCING GUIDELINES ARE DESIGNED TO INDICATE TO JUDGES THE EXPECTED SANCTION FOR PARTICULAR OFFENCES. THEY ARE INTENDED TO PREVENT ARBITRARINESS AND ENSURE PARITY OF SENTENCES, TO REFLECT PARTICULAR FACTS AND CIRCUMSTANCES OF EACH CASE.

AS YOU DELIBERATE ON THIS SENTENCING GUIDELINES, I IMPLORE YOU TO REFLECTS ALL THESE ISSUES AND MAKE THIS EXERCISE CONCERTED EFFORT TO REFLECT THE CARDINAL OBJECTIVES OF SENTENCING AND MORE IMPORTANTLY MAKING OUR CRIMINAL JUSTICE SYSTEM, ROBUST, GIVING JUSTICE TO VICTIMS OF CRIMES AND PROTECTION OF SOCIETY FROM CRIMES.

THE GOVERNMENT OF HE, GOVERNOR AKINWUNMI WILL CONTINUE ITS UNFLINCHING SUPPORT TO THE JUDICIARY.
